hese Affiliate Terms and Conditions (“Agreement”) govern your participation in the Heart N Soul Affiliate Program (“Program”). By signing up as an affiliate, you agree to the terms and conditions below.

Eligibility

To become an affiliate, you must:

Be at least 18 years of age.Have an active website, email list, or social media presence aligned with ethical marketing practices.Comply with all local laws and regulations in your country of residence (including Australian Consumer Law if applicable).

Explosion Marketing reserves the right to reject or terminate any affiliate account at its sole discretion.

Commissions

You will earn a commission of:

10% per successful sale or client referral, depending on the specific offer or program. Commission will be calculated based on the net sale price (excluding taxes, discounts, and refunds).

Payouts:

Commissions are paid out monthly, on or around the end of the following month.There is no minimum payout threshold .Payments are made via PayPal or Stripe. You are responsible for ensuring your payment details are accurate and up-to-date.

Cookie Tracking

Our cookies are tracked for 365 days unless the client clears their cache.

Promotional Guidelines

As an affiliate, you agree to:

Use only approved creative assets and copy provided or pre-approved by Heart N Soul Retreats.Avoid false claims, misleading information, or unethical sales tactics.Clearly disclose affiliate relationships in compliance with the Australian Competition and Consumer Commission (ACCC) and international best practices (e.g., “As an affiliate, I may receive a commission…”). NOT engage in spam, unsolicited emails, fake reviews, or ad bidding on branded terms.

Violation of these terms may result in termination and forfeiture of any unpaid commissions.

Refunds and Chargebacks

If a customer you referred requests a refund or initiates a chargeback:

Your commission for that transaction will be voided or deducted from your next payout.This includes purchases that are not completed due to payment failure or fraud.

Intellectual Property

You are granted a non-exclusive, revocable right to use Heart N Soul's logos, banners, and links for promotional purposes.

You may not alter these assets or present yourself as a representative or employee of Heart N Soul.

Termination

You may terminate this Agreement at any time by notifying us in writing.

Heart N Soul may terminate your participation at any time, with or without cause, including but not limited to:

Violation of these terms. Misrepresentation of our brand. Inactivity (no referrals for a period of 6 months).

Upon termination, any unpaid commissions that are not due (due to refund periods or violations) will be forfeited.

Limitation of Liability

Heart N Soul shall not be liable for indirect, incidental, or consequential damages arising out of this Agreement.

You agree to indemnify and hold harmless Heart N Soul against any claims, losses, or liabilities arising from your participation in the Program.

You may terminate this Agreement at any time by notifying us in writing.

Changes to Terms

Heart N Soul reserves the right to update or modify these terms at any time. You will be notified of any significant changes via email. Continued participation after changes constitutes your acceptance of the revised terms.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of New Zealand.
Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts in New Zealand.
